Info on patent trolls

This guy (Michael Risch) actually did a survey. It seems like cheating to add actual systematic knowledge to the debate. . . .

What I’m wondering is, can I file a retroactive patent on the concept of albedo? I think I could make millions off the applications to cooking alone.

I can’t get the paper to download, but the ten most litigious entities seems like a heavy ascertainment bias; repeat players who can lose for legal costs may play nicer and seek less risky cases. Also, the limited visibility of cases that settle pre-trial is troublesome. Are they better patents, or worse patents targeted at more vulnerable companies? Looking at “partially invalidated” isn’t very useful. If you’ve written a patent it often goes something like “absurd claim, absurd claim, real claim, absurd claim”. I’m told that it’s useful to have something for the PTO examiner to strike, but not uncommonly they OK an absurd claim too.
